DPDP Act 2023: Strengthening India’s Digital Privacy Framework

3
The rapid expansion of digital services has transformed how personal information is collected, stored, and used. With millions of Indians relying on online platforms for banking, healthcare, education, and communication, safeguarding personal data has become a national priority. The Digital Personal Data Protection (DPDP) Act 2023 represents India’s first comprehensive attempt to establish a structured legal framework for protecting individuals’ digital information.
The law focuses on the responsible processing of personal data by organisations while strengthening the rights of individuals, referred to as “data principals.” It requires companies and institutions to collect data only for legitimate purposes and with clear consent. Individuals are also granted the ability to access, correct, and erase their personal information when necessary. These provisions aim to enhance transparency and ensure that citizens maintain control over their digital identities.
A key feature of the DPDP Act is the accountability it places on organisations handling data, known as “data fiduciaries.” They must implement reasonable security safeguards to prevent breaches and misuse of personal information. In cases of non-compliance, the Act empowers regulatory authorities to impose significant financial penalties, encouraging organisations to prioritise data governance and cybersecurity practices.
Beyond legal enforcement, the Act signals a broader shift toward a privacy-aware digital ecosystem in India. As businesses continue to innovate through artificial intelligence, cloud services, and digital platforms, responsible data management will become central to building trust with users. The DPDP Act 2023 therefore represents not only a regulatory measure but also a step toward a more secure and transparent digital future for the country.
